1. Introduction
In short: These terms cover how you use CoHire. Please read them. If you do not agree, please do not use the Platform.
These terms apply when you use the CoHirewebsite and services. We call that the "Platform", including on phones and computers.
The Platform connects Lenders (people who list tools and equipment for rent) with renters (people who hire them). CoHire does not own listed items - the Lender does or has lawful right to rent them out. Sometimes we say "we", "us" or "CoHire": that means TWELVE PIXEL PTY LTD (ABN 14 670 579 432) trading as CoHire. "You" means anyone with an account, whether Lender, renter, or both.
By using the Platform, you agree to these terms. If you do not agree, please do not use it.
2. The service
In short: We run a marketplace that connects Lenders and renters. The hire itself is between you and the other person. We provide the site, payment tools, and support described here.
We run an online marketplace: listings, bookings, messaging, and taking payments. The actual rental agreement is between the Lender and the renter. We provide the site, payments help, and support according to these terms.
The Platform connects users and is not a shop or rental yard. We do not guarantee the quality, safety, or legality of listed items, or how people behave on or off the site.
Hires are arranged between users, so there are normal practical risks (such as item condition and how people act). You take part in rentals at your own risk to the extent the law allows. This does not remove any rights you have under the Australian Consumer Law or other non-excludable law.
Only bookings on CoHire: Secure payments, dispute help where we offer it, and our fee rules only apply when you book and pay through the Platform. If you arrange or pay for a hire completely outside CoHire, those features do not apply. This does not take away any rights you have under the Australian Consumer Law or other laws that cannot be waived.
We are not your boss or business partner: We are not your agent, employee, employer, partner, or joint venture. Running the hire marketplace does not make us part of your rental deal with the other person. These terms do not create an employment, agency, or partnership relationship between CoHire and you, whether you list items, rent them, or use the Platform in another way.
What we mean by "reasonable": When these terms mention reasonable costs or typical market value, we refer to objective benchmarks: current retail replacement price (adjusted for age), standard commercial hire rates in the same area, or professional repair quotes. This helps keep amounts fair for everyone.
3. Entire agreement and changes
These terms, plus policies we link to (including our Privacy policy and Lender platform support (limited)), are the full agreement between you and us about using the Platform. They replace earlier informal understandings on the same topic.
We may update these terms. We will publish the new version with a new "Last updated" date. If you keep using the Platform after that, that may count as accepting the update, except where the Australian Consumer Law or other mandatory law says otherwise.
For a booking that is already confirmed, the terms that applied when you made that booking still apply to that booking, unless the law requires something different.
Using the Platform (including confirming "I Agree" or signing up where shown) means these terms govern your relationship with us. Separate rental arrangements between users stay between those users, subject to mandatory law including the Australian Consumer Law, which is not waived by clicking through.
4. Who may use the Platform
Please be at least 18 (or the age of majority where you live). The Platform is not directed to children under 18. Use accurate details when you sign up and keep them up to date. If you use the Platform for a business, please make sure you are allowed to commit that business. Individual and business owners may list items. Lenders need the right to rent out what they list.
5. Accounts and security
Please look after your login. You are responsible for what happens on your account. Do not share your account or let others use it as if they were you. If you think someone else has access, tell us at support@cohire.com.au so we can help.
Identity verification: We may ask you to verify your phone number (for example by SMS code). Lenders who want payouts usually need to complete identity and payout checks through our payment provider, Stripe. We may also ask for extra checks to help prevent fraud or meet the law. If a required check is not completed, we may pause bookings, listings, or payouts for a while.
6. Payments and Stripe
In short: You hire through CoHire and pay with a card or wallet through our payment partner, Stripe. For most bookings you request first, the Lender accepts, then you add payment details. We usually place a hold on your card about two days before the hire starts, and usually take the payment after return. Lenders get paid through Stripe after the hire completes. The details below explain how that works.
How payments work and checks
- Renters pay through Stripe. Stripe has its own terms that also apply when you use it.
- When you check out, you ask us and Stripe to handle payments, refunds, and card or wallet actions for that booking, as shown on screen and in these terms.
- Sometimes Stripe or we need a quick identity or safety check (for example to help prevent fraud). Please complete those when we ask.
- If a required check is missing or does not go through, we may pause payments or your account for a while. We aim to do this fairly and only as needed to meet the law and keep users safe.
- We may also pause payments or accounts while we look into signs of misuse - for example unusual activity, payment claims that do not match what happened, or repeated chargebacks that do not look genuine. We use this to protect users and the payment system. Your rights under the Australian Consumer Law and other laws that cannot be waived still apply.
Lender payouts
If you earn money as a Lender, your payout goes through Stripe once your payout setup is ready.
- If your Stripe account is ready, hire funds can go to your connected account when payment is captured. CoHire's fees (including the success fee) are taken as described in Fees.
- If your Stripe setup is not finished yet, we hold the captured booking funds until setup is complete, then transfer them to your connected account.
- Timing: We do not promise exact payout dates. Banks, checks, disputes, and normal processing can add delay.
- Holds: Where the law allows, we may delay or hold a payout while we look into fraud, disputes, chargebacks, compliance, or wrong amounts. We try to explain holds when we can and resolve them in a fair time.
- Please keep your payout details up to date wherever the Platform asks for them.
Bank details: your responsibility
- Please double-check your BSB, account number, and name before you save them. We pay using the details on your account.
- We do not separately check that those details match your real bank account.
- If money goes to the wrong account because the details you entered were wrong, we may not be able to get it back. We will help where we reasonably can. Your statutory rights still apply.
Prices before you pay and saved cards
- Before you confirm payment, checkout shows what you will pay: rent, any small service fee, any deposit shown for that booking, delivery (if selected), and similar charges. If something is not shown or is AUD $0, it is not charged for that booking.
- Saved card: When you pay, you ask us and Stripe to save your payment method (where the site allows) for this booking and for later allowed extra charges described here and at checkout - for example fair costs for damage or loss (see Damage, loss, deposits, late return), any deposit shown for that booking, and late fees that match what you saw when you booked.
- Notice before extra charges: Where we can, we will try to tell you first (email or in-app). Timing can vary if something is urgent or disputed. Our Privacy policy explains our usual approach to notice for off-session charges.
- Extra charges should be fair, backed by evidence where relevant, and consistent with these terms. Your rights under the Australian Consumer Law still apply.
- You can manage or remove saved cards in your profile where the Platform allows. If an active booking still needs that card, the site may ask you to keep it until the booking no longer needs it. Removing a card may mean you need to add a new one before your next booking.
When we hold and take payment
- Request, then pay: For a normal booking, send your request first. After the Lender accepts, add or confirm your payment method and finish checkout. Until that is done where required, the hire is not ready for payment hold or handover. Completing checkout means you allow us (through Stripe) to store payment details and charge as described in these terms.
- Instant book (where offered): Some listings confirm faster. If the Platform asks for a saved payment method first, please add one before the booking is created.
- Hold before start: We usually place a hold on your saved payment method about two days before the rental starts (Australian calendar timing used by the Platform), with a final try one day before. This is a hold, not the final charge.
- When we take the money: We usually capture payment after return (or shortly after the hire end date). We may capture earlier if needed so the hold does not expire.
- If the hold does not work: If payment is still not authorised the day before start, CoHire cancels the booking. Please do not hand over the item without a successful hold. We may also cancel earlier if payment cannot be completed after acceptance where the Platform requires it.
- Your agreement: By using the Platform, you agree to this hold-then-charge flow, including charging your saved card when these terms allow it.
If payment does not go through
- If a hold or capture does not succeed, we may try again where that is reasonable, tell you what happened, cancel the booking under these terms, and ask you to add a working payment method before more bookings.
- If you owe amounts under these terms (for example late fees or damage assessed under Damage, loss, deposits, late return), we may try to collect them from your saved payment method and, where needed, take other lawful steps. This does not guarantee the Lender will recover everything.
Cancellation policy
- Free cancellation: You can cancel with no charge up to 1 day before the rental start date (Australian calendar date used by the Platform). If payment is only on hold, we release the hold. If payment was already taken, we refund that booking amount when free cancellation applies.
- Late cancellation: If you cancel on the rental start date and payment has already been taken, we may keep 50% of 1 day rent and the service fee. If payment is only on hold at that time, we release the hold and do not take those late-cancellation amounts. The Platform shows the impact before you confirm a cancellation.
7. Fees
In short: Listing is free. We charge a small service fee on bookings, and a success fee on successful Lender payouts. Checkout and Earnings show the exact amounts.
Listing is free. Creating and publishing a listing does not cost a listing fee. CoHire charges fees only on bookings made and paid through the Platform, as described below.
Service fee
CoHire may charge a 5% service fee on bookings (also described as a small service fee). The fee is calculated from the rental amount, rounded up to the nearest whole dollar (AUD), and never less than AUD $1 per booking when a fee applies. Checkout shows the exact amount clearly before you confirm payment, including whether it is included in the total or added on top.
If GST applies to our service fee, the amount you see at checkout includes GST (you do not pay extra on top unless checkout clearly says otherwise). We may change how the fee is calculated, the minimum, or rounding by updating these terms and/or checkout. We will follow the Australian Consumer Law and other law when we do.
Success fee (Lenders)
After a successful hire, CoHire takes a 5% success fee from the Lender's hire earnings for that booking (the rental amount). The success fee is deducted when payout is calculated after the hire completes and a short dispute window has passed (currently 24 hours after hire payment is released for payout processing, unless the Platform shows a different window). Delivery amounts you charged are handled as shown in Earnings and checkout records.
If GST applies to the success fee, amounts shown for that fee include GST unless we clearly say otherwise. We may update the success fee percentage by changing these terms and/or the amounts shown in Earnings. We will follow the Australian Consumer Law and other law when we do.
These fees apply to bookings made through the Platform. Please do not try to avoid them by paying off the Platform. Serious or repeated attempts to do that may lead us to pause or close your account. For what we retain on late cancellation, see Cancellation policy above.
GST and taxes
Please look after your own taxes (including income tax and GST if you run a business). Other checkout and payout amounts are in AUD as shown. If you are unsure, speak to a tax adviser.
8. Chargebacks
Please only dispute a payment with your bank when you have a genuine reason under the law or card rules. Misuse of chargebacks can lead us to pause or close an account. We may share information with Stripe and others as needed to resolve disputes, based fairly on our records.
9. Listings (Lenders)
In short: List only items you may lawfully rent out. Describe them honestly. Keep them safe and in working order. Declared value is a guide for us, not insurance. Some items are never allowed; some need our written go-ahead first.
Lender key responsibilities
- Please make sure the item is safe, clean, working, legally owned, properly maintained, and accurately described.
- Please tell renters about any known defect, damage, limitation, or safety requirement before the item is rented.
- You are responsible for claims, loss, damage, injury, or cost caused by a faulty, unsafe, incorrectly described, or poorly maintained item.
List only items you are allowed to rent. Descriptions should be honest (condition, price, location, availability, deposits, and so on). One listing should normally be one item unless the Platform clearly allows otherwise. Please do not use listings for spam, unrelated ads, illegal goods, or items that are unsafe or cannot lawfully be rented.
Extra rules in your listing cannot override these terms or how booking works on the Platform. We may remove or edit listings that break these terms or the law.
Safety: Please follow Australian product safety rules that apply to your goods. Do not list items you know or should know are unsafe. We do not inspect every item before it goes live.
Do not list illegal items, weapons, hazardous material, stolen goods, or things that need licences you do not have. We may remove those listings.
Declared item value
When the Platform asks for item value (or similar), please enter your honest, good-faith estimate of what you could realistically sell the item for today in its current condition (for example on a second-hand marketplace). Please do not inflate this figure to seek higher recovery, Platform support, or renter charges.
Declared item value is information you provide to help run the Platform and assess disputes. It is not insurance, not a guaranteed payout, and not the automatic amount we will charge a renter or pay you if something goes wrong.
If the item is damaged, lost, or not returned, amounts remain reasonable and are assessed using fair market value, evidence, and the benchmarks in these terms (including that repair, replacement, and loss claims may be less than original retail price or your declared value). We may reduce or disregard a declared value that appears misleading or inflated when reviewing a claim.
Repeated or serious misrepresentation may lead us to adjust outcomes, pause listings, or take other action under these terms.
Prohibited and restricted listings
These rules help keep the marketplace workable and safer at launch. We may remove or restrict listings that do not fit the intended use of the Platform.
Never list:
- Stolen goods, or items you do not own or are not lawfully allowed to rent out.
- Weapons, ammunition, explosives, fireworks, or items mainly intended for illegal use.
- Drugs, drug paraphernalia, or other illegal substances.
- Counterfeit goods, or goods subject to an active safety recall you have not disclosed and addressed (check ACCC and recalls.gov.au where relevant).
- Items that require a licence, permit, or qualification you do not hold.
- Registered motor vehicles, motorbikes, or road-going scooters; trailers, caravans, or motorised boats; ride-on machinery (for example forklifts, excavators, or skid steers).
- Chainsaws, log splitters, wood chippers, scaffolding, elevating work platforms, boom lifts, industrial pressure washers, pressure vessels, welding or oxy-fuel equipment, large generators (typically over 5 kVA), motorised augers, post-hole borers, or stump grinders.
- Hazardous chemicals, pesticides, pool acid, fuel, or gas bottles (unless empty and clearly disclosed).
- Asbestos-related equipment, biohazard items, or medical or life-support devices.
- Live animals, food for consumption, cash, gift cards, or securities.
- Services-only listings with no physical item to hire.
Restricted at launch (contact support@cohire.com.au before listing):
- High-injury power tools (for example circular saws, angle grinders, or nail guns).
- Ladders over 3 m or extension ladders.
- Concrete mixers, jackhammers, demolition tools, large compressors, or spray equipment.
- Gas-connected BBQs or commercial catering equipment (for example deep fryers).
- Large commercial inflatables (for example jumping castles or slides).
- E-bikes, e-scooters, or drones beyond small recreational toys (aviation rules may apply).
- Items valued above AUD $1,000 unless we approve in writing.
Generally suitable at launch (if safe, lawful, and accurately described) include party gear, film and photography equipment, domestic home and garden items, sports and leisure gear, small DIY tools (for example drills and sanders, not the restricted tools above), and electronics suited to ordinary household or event use.
We may also restrict or remove listings that we consider unusually high in value or risk for the Platform, even if not listed above. We try to apply this fairly.

Condition photos: Please take clear, dated photos of each item at pickup and return where you can. They make disputes fairer and support evidence-based assessment of damage or loss claims (see Bookings and Damage, loss, deposits, late return).
Lender representation (safety and fitness): By listing, you confirm that items you list are safe and lawful to supply for ordinary rental use, you take reasonable steps to maintain them appropriately and to identify applicable product recalls or mandatory safety notices (such as ACCC or recalls.gov.au, where relevant to the goods), and you hand over items in substantially the advertised condition unless you have clearly disclosed defects. CoHire does not inspect or maintain listed items - the Lender is responsible for complying with Australian product safety obligations that apply before handover, subject always to statutory rights neither party may exclude under the law.
10. Bookings
In short: Renters request, Lenders accept or decline (or use instant book where offered), then payment details are added. Stick to the agreed pickup and return. Take dated photos at both ends.
- Booking requests: Renters send a request with dates and pricing shown in the flow. Lenders accept or decline as the Platform allows. Some listings may offer instant book, which can confirm faster when the renter meets the payment and other requirements shown on the listing.
- Payment after acceptance: After a Lender accepts a standard request, the renter completes checkout and saves a payment method as described in When we hold and take payment. A booking may be created in a confirmed state before final capture completes, and payment status is tracked separately. Until the renter adds payment details where required, the booking is not ready for authorisation or handover.
- Both sides should stick to the agreed pickup, return, dates, and place. Pickup or delivery is whatever you agree unless the Platform states otherwise. Listing prices, photos, and availability should match what is offered; Lenders should keep calendars and stock accurate.
- Lenders may ask for ID at pickup or delivery. Please say so clearly beforehand. For small tools, phone verification through the Platform may be enough.
- Proof of condition (required): Both sides should take dated photos of the item at pickup and return. They matter for disputes and for assessing damage or loss claims fairly. Without clear evidence from the booking timeline, we may dismiss or limit claims at our discretion. - Missing pickup may count as a cancellation under the rules on the Platform. Confirmed bookings should go ahead unless cancelled under our cancellation policy.
Reviews and ratings
After a completed hire, you may leave a star rating and optional written review. Please keep reviews honest and based on that booking. Do not post fake, paid, or misleading reviews. We may remove reviews that break these terms or the law. How and when reviews become visible follows the Platform rules at the time (for example, waiting until both sides have reviewed or a short visibility period has passed).
11. Cancellations and refunds
Cancellations, refunds, and fees follow what the Platform showed when you booked, plus any policies we publish. If a Lender cancels a confirmed booking, the renter should get a full refund of what they paid for that booking, subject to the law. If the Lender does not make the item available as agreed and the renter can show that (for example using messages and Platform records), the renter should get a refund as our policies and the Australian Consumer Law allow.
Once a refund is approved, we process it promptly through our payment provider. After that, how long it takes to reach you depends on banks and payment providers and is largely outside our control; it is often several business days. We try to be consistent and fair based on the evidence we have.
We may cancel a booking or pause accounts if these terms are broken, or for safety or operations. When we can, we will explain why and what happens next.
12. Damage, loss, deposits, late return
In short: During the hire, the renter looks after the item. If it is damaged, lost, stolen, or not returned, the renter is responsible for reasonable repair or replacement costs, usually based on fair market valuefor the item as used. Late fees only apply if they were clearly shown when you booked and are fair. We may try to collect from the renter's saved card for the Lender. We are not an insurer. Limited discretionary Lender platform support may apply only after recovery is unsuccessful - see that page for details.
Renter key responsibilities
Please use the item safely, carefully, and legally during the rental period. You are responsible for damage, injury, loss, fines, penalties, or third-party claims caused by your use, misuse, transport, storage, or possession of the item.
- How we value costs: Repair, replacement, and loss amounts must be reasonable and based on available evidence. We anchor money claims in fair market value for the item as used (age, condition, normal wear). That can be less than the original retail price. A Lender's declared item value on a listing is not binding proof of value and does not replace independent evidence. We may assess claims below a declared value where evidence or fair market value supports a lower figure. Fees and charges must stay proportionate to what was shown at booking and consistent with the Australian Consumer Law.
- Renter responsibility (in plain terms): The renter is fully responsible for the hired item during the booking. If the item is damaged, lost, stolen, not returned, or damaged on purpose, the renter is liable for reasonable repair or replacement costs, often anchored in fair market value for the item as used. Late or other fees apply only if they were clearly shown in the listing or booking flow and are reasonable (not penalties in disguise).
- Third-party harm: During the hire period, the renter is primarily responsiblefor the safe and lawful use of the item and for any loss, damage, injury, death, fine, penalty, or third-party claim arising from the renter's use, possession, transport, storage, or return of the item, except to the extent caused by a defect in the item that the Lender knew or ought reasonably to have known about and did not disclose. This includes damage to buildings, vehicles, landscaping, utilities, and other property that is not the hired item. Please do not use any item for a purpose, location, or manner that is unsafe, unlawful, or inconsistent with the listing, manufacturer instructions, or applicable licences or permits.
- Recovery: CoHire may try to recover amounts owed from the renter's saved payment method for and on behalf of the Lender, subject to evidence, checkout consent, and the law. This is not a guarantee of full recovery.
- General charges: We may charge the renter's saved card for other fair amounts these terms allow, with evidence and in line with checkout consent (see Prices before you pay and saved cards above).
- Evidence: Lenders should provide proof that fairly shows what happened (photos, receipts, quotes, etc.). Renters should cooperate honestly. Dated pickup and return photos from both sides help assess claims fairly.
- If you cannot agree: We may step in as a facilitator: we can look at the evidence and suggest a fair outcome. Unless we agree in writing to a separate binding process for a specific case, we are not a court or arbitrator and our suggestion is not binding. You may still have rights under the Australian Consumer Law and other law. CoHire is not an insurer; what can be recovered depends on evidence and these terms.
- Lender fallback (discretionary): If we cannot successfully charge the renter's saved card for harm or non-return after a reasonable attempt, we may consider discretionary Lender platform support within the cap described on that page. This is not insurance and not a guaranteed payout.
Late return
- On time: Please return the item on the agreed date and time.
- Grace: A short grace period only applies if the Lender and renter both agree.
- Late fees: If you return late, you may owe extra rent as shown in the listing or booking flow. Fees must be reasonable (fair compared with typical hire rates and what was shown when you booked), not unlimited penalties.
- Very late: If the item is not returned within a reasonable time (fair given how long the hire was and whether the parties were in touch), it may be treated as continued hire with extra charges based on the agreed daily or period pricing shown for the booking, rather than as a separate product feature.
- Other bookings:If your late return affects someone else's booking, you may owe reasonable costs that result, based on available evidence and typical market value where that applies.
- Payment: Late fees may be charged to the saved card under the same consent as other allowed extra charges (see Prices before you pay and saved cards above).
- Talk to each other: Renters should tell the Lender as soon as possible if they will be late. Lenders should be fair to both sides where they can.
- Fairness: All charges in this section should be reasonable, proportionate, and based on prices and information shown at booking, available evidence, and typical market value for money amounts (or clearly updated with your consent if the Platform requires it).
- If the item cannot be collected or returned: If that is due to the renter not responding or not being available, the Lender should make a fair effort to contact them. If there is no response in a reasonable time (fair in the circumstances), the item may be treated as not returned and further charges may apply as per agreed pricing and reasonable costs tied to evidence and typical market value where relevant.
Responsible use
- Please use hired items with care that a fair person would use in the same situation.
- Damage from deliberate misuse, reckless behaviour, or ignoring clearsafety instructions is the renter's responsibility under the liability rules above.
- Insurance: We do not provide public liability, product liability, property, or personal injury insurance for users or third parties unless the booking flow clearly says something different. Any optional deposit, card recovery, or Lender platform support is limited, discretionary, and not a substitute for insurance. Renters and Lenders should maintain their own insurance where they need broader protection.
Lender platform support (overview)
CoHire does not own listed items; Lenders retain title subject to law and their agreement with the renter. We may offer limited, discretionary Platform support for qualifying Lenders when renter recovery is unsuccessful - not insurance.

Legal responsibility
This program is limited and is not insurance. It does not stop Lenders or renters from bringing legal claims against each other where Australian law allows. Everyone remains responsible for their own actions and liabilities beyond this program.
13. Disputes between users
Please try to sort things out with the other person first. Use Platform dispute tools if we provide them. We may help you talk and suggest a fair outcome based on what you send us. We are not a court or binding decision-maker unless we clearly agree otherwise in writing for a specific case. We aim to review disputes within a reasonable time; complex cases can take longer.
If you need a binding decision, you may use appropriate legal channels that apply to you (for example courts or tribunals), alongside anything else the law allows. Nothing here limits rights you cannot waive under the Australian Consumer Law or other mandatory law.
14. Conduct
Please use the Platform lawfully and respectfully. Do not harass people, misuse personal data you get through the site, fake reviews or bookings, break security, dodge fees, scrape or overload the site, or use it for fraud or money laundering. Do not list items you are not entitled to rent. Do not create misleading listings or hide material defects. We may pause or close accounts and remove content if there is a breach or serious risk.
Messaging: Please keep messages and payments on the Platform so hires stay safer and clearer. Do not use chat to share payment details off-platform, harass others, or commit fraud. We may filter, limit, or make threads read-only in some booking stages. Please do not move bookings or payments off the site to avoid fees or the help described in these terms. Serious or repeated breaches may lead us to pause or close an account.
We may also pause accounts if someone repeatedly causes damage, returns items late, or otherwise breaks these terms. We try to do this fairly to protect users and the Platform.
Indemnity
Where the law allows, please cover CoHire, TWELVE PIXEL PTY LTD, and their staff and contractors for reasonable losses, damages, costs, and claims (including fair legal fees), in line with available evidence and typical market value where money is involved, that arise from: you breaking these terms; misusing the Platform; your listings, hires, or use of items; you breaking the law; or third-party claims tied to your content or conduct on the Platform.
This indemnity is limited by the Australian Consumer Law and other laws that restrict what businesses can ask consumers to cover.
15. Intellectual property and content
We and our licensors own the Platform software, branding, and materials. Your own content stays yours. You give us a non-exclusive licence to host, show, and adapt what you upload (listing text, photos, etc.) as needed to run, promote, and improve the Platform until you remove it and we have had a reasonable time to take it down (fair for processing and backups), subject to law and normal backups. Please only upload content you have the right to share. Please do not copy Platform materials except as needed to use the service.
16. Privacy
We handle personal information as described in our Privacy policy and in notices from our payment providers.
17. Availability
We aim to keep the Platform running smoothly, but outages happen. We may pause access for maintenance, security, or reasons outside our control.
Events outside our control
We are not liable for delay or failure when caused by events outside our reasonable control (for example natural disasters, war or terrorism, unrest, large-scale internet or power failures, government-mandated pandemic rules, serious supplier labour shortages, or failure of services we rely on, such as payment networks), except where the Australian Consumer Law or other mandatory law says otherwise. When that happens, we aim to get back to normal as soon as we fairly can in the circumstances.
18. Liability
In short: Your rights under the Australian Consumer Law stay intact. Where the law allows us to limit liability for using the Platform, that limit is the fees you paid us in the 12 months before the claim. Claims about the hired item itself sit between the renter and the Lender - we provide the Platform, not the gear.
Consumer rights: Nothing in these terms takes away consumer guarantees, rights, or remedies you have under the Australian Consumer Law (including under the Competition and Consumer Act 2010(Cth)) or other non-excludable law. If you are a "consumer" under that law, those rights apply to the services we supply to you (such as providing and operating the Platform), as well as any separate rights you have against other users about the hire itself.
Other liability: Where the law allows, the Platform is provided without extra express warranties beyond what the law implies. We are a marketplace: we do not control item condition, safety, legality, or how other users behave. Subject to consumer guarantees and other rights that cannot be excluded, if we can lawfully cap liability our total liability to you for loss from these terms or your use of the Platform (whether in contract, negligence, or otherwise) is limited to the total fees you paid us in the 12 months before the event that led to the claim. That cap does not apply to claims or remedies that cannot be limited under the Australian Consumer Law.
No liability for equipment: CoHire provides the Platform only. We are not a manufacturer, mechanic, or safety inspector. To the maximum extent allowed by the Australian Consumer Law, CoHire is not liable for physical injury, death, or property damage caused by a listed item. Any such claims sit between the renter and the Lender.
Third-party claims:If a third party makes a claim against CoHire relating to an item listed or hired through the Platform, the renter and/or Lender whose listing or booking is involved should cooperate with CoHire and, to the extent permitted by law, cover CoHire for reasonable losses and costs arising from that claim, except to the extent caused by CoHire's own wrongful act or omission. This does not make CoHire responsible for paying third-party claims on behalf of users.
19. Termination
We may pause or end access for serious or repeated breach, risk, fraud, abuse, illegal activity, off-platform payment schemes, security issues, or behaviour that does not fit the intended use of the Platform. We try to apply this fairly for everyone's safety. You may stop using the Platform at any time. Parts of these terms that should naturally continue (fees, liability limits where allowed, intellectual property, disputes) still apply after access ends.
20. Governing law and geography
We operate the Platform from Australia mainly for Australian users. These terms are governed by the laws of New South Wales, Australia, and the Commonwealth of Australia where it applies. If you use the site from another country, please still follow local law where it applies to you.
21. Complaints and dispute resolution
If you have a complaint or dispute with us, please email support@cohire.com.au first and include enough detail for us to look into it. We will follow any mandatory complaint process required by law. Nothing here limits non-excludable rights under the Australian Consumer Law or other applicable law.
Subject to those rights, the courts of New South Wales, Australia have non-exclusive jurisdiction. You may also have rights to use other forums the law allows (for example a tribunal). You can also reach us through the Platform for questions about these terms.
